These Terms of Service ("Terms") govern your use of my-mamma.com and your purchases of food, catering, gift cards, and related services from MPH LLC, doing business as My Mamma ("My Mamma," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms.
1. Orders and Pickup
Online orders are offers to purchase and are confirmed by email from hello@my-mamma.com. We may refuse or cancel an order due to product availability, errors in pricing or description, or suspected fraud. Pickup times are estimates and may vary with kitchen volume.
2. Pricing and Payment
Prices are shown in U.S. dollars and may change without notice. Applicable taxes are added at checkout. Payment is processed securely by our payment processor at the time of order.
3. Gift Cards
Gift cards and gift certificates issued by My Mamma are governed by Florida law, including Florida Statutes § 501.95. Consistent with that law:
- Gift certificates and credit memos sold to a consumer do not expire and the face value does not diminish over time.
- We do not charge a service fee, dormancy fee, or maintenance fee that reduces the face value of a gift certificate, except as permitted by § 501.95.
- Gift cards are redeemable for food and beverage at My Mamma and are not redeemable for cash except where required by law.
- Lost or stolen gift cards are treated like cash; we may be unable to replace them without proof of purchase.
4. Reservations
Reservations made through our reservation partner (OpenTable) are subject to that provider's terms. Please honor or cancel your reservation in advance so we can serve other guests.
5. Catering and Events
Catering orders may require a deposit and advance notice. Final guest counts, menu selections, and cancellation terms are confirmed in your catering agreement. Deposits may be non-refundable within a stated window before the event, as set out in that agreement.
6. Allergens and Food Safety
Our food is prepared in a kitchen that handles gluten, dairy, eggs, nuts, shellfish, and other allergens. We cannot guarantee that any item is free of a given allergen. Please tell us about allergies before ordering.
7. Intellectual Property
All content on the Site - including the My Mamma name, logo, text, images, and menus - is owned by or licensed to MPH LLC and may not be used without our prior written permission.
8. Disclaimers and Limitation of Liability
The Site and our services are provided "as is" without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, MPH LLC is not liable for indirect, incidental, or consequential damages arising from your use of the Site or our products, and our total liability for any claim will not exceed the amount you paid for the order giving rise to the claim.
9. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to their jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on this page with a revised "Last updated" date.
